For most the fall of the LTTE and the death of Prabakaran was treated not only with shock but it essentially put an end to decades of terror upon an entire country that extended globally creating an empire that used foul & wicked means to fill its deadly kitty.
It was thought that the elimination of the upper tiers of the LTTE leadership, the surrendering of remaining LTTE cadres & gradual arrest of the remaining hardcore LTTE fighters was purely a sweep up operation until authorities netted in their biggest prize next to Prabakaran – the arrest of the infamous KP who is now in an undisclosed location & providing vital information to Sri Lanka’s intelligence units..
Two shocking events unveiled to remaining LTTE supporters and those attempting to revive the LTTE by giving it a new face that the ghosts of revenge are now coming out.
The Galleon Group and its founder Raj Rajaratnam were accused of insider trading then on 22nd October 2009 a group of survivors of LTTE terrorist bombings through US Attorney’s Motely Rice (www.motleyrice.com) sued Rajaratnam and his father claiming they knowingly provided financial support to the LTTE. The lawsuit was filed (under the Alien Tort Claims Act of 1789) in the District of New Jersey with a 91 page seven-count complaint culminating from a year long investigation.
The significance of this Act, is that it gives U.S. district court jurisdiction "of any civil action by an alien for tort only, committed in violation of the law of nations or a treaty of the United States." The complaint states that between 2004 and 2009 the LTTE conducted fatal attacks resulting in the death of over 4000 victims and that Raj Rajaratnam and his family foundation provided millions (approx USD5m) of funding to a “charitable organization” namely the Tamil Rehabilitation Organization (TRO) which was designated by the US Treasury Department in 2007 as a “charitable organization that acts as a front to facilitate fundraising and procurement for the LTTE” and thereafter the TRO’s assets were immediately frozen. The complaint declares that in 2004, Raj Rajaratnam had given US1million to the TRO’s US branch and the money was later funneled to TRO in Sri Lanka & then to the LTTE.
For Motley Rice (South Carolina) experts in anti-terrorism (with an exclusive practice group called Anti-terrorism & Human Rights) to take up the case against Raj Rajaratnam on behalf of victims of LTTE terrorism requires closer deliberation.
Motley Rice attorneys have pioneered anti-terrorism-financing litigation with landmark lawsuits brought on behalf of the victims of 9/11, anti-Israeli suicide bombings, IRA bombings and other terrorist attacks. Motley Rice has co-counseled with Lite DePalma Greenberg and Rivas, LLC, of Newark, New Jersey on this case. The law firm of Lite DePalma Greenberg and Rivas, LLC has earned a national reputation for litigation of complex civil and criminal matters. They have extensive litigation experience in state and federal trial and appellate courts.
What is special about the firm accepting to file a case against the Rajaratnams is that they are taking no legal fees from the victims except a share of the ruling which they are positive would favor the victims. This is extremely pertinent for these victims who cannot afford any such foreign counsel or funds for investigations and should encourage more victims to come forward & make their allegations clear and record their statements against supposed LTTE supporters who are now sheltering themselves in foreign climes probably looking for ways to resurface using the LTTE bogey once more.
s such the establishment of the Association for the Victims of LTTE terrorism is poignant by the Manel Mal Movement backed by stalwarts Mr. S.L. Gunasekera, Col. Anil Amarasekera & other nationalists.
Victims of LTTE terrorism be they even members of the armed forces are welcome to write to the Manel Mal Movement, 18 Rodney Place, Borella, Colombo 8. Tel: 2667512 / Fax: 2699666 or log on to their website: www.victims-of-ltte-terrorism.com
Slumbering LTTE supporters must now be alert that their days as numbered as the ghosts of the innocent victims are now coming out to haunt them & their worst nightmares are about to commence with litigation that they would never imagined they would experience.
